Description
Photograph of photograph of the last will and testament of Robert Fuller Fitz, Southern California, 1932. “interest in said trust fund to the Old Colony Trust Company, of Boston, Massachusetts, but in trust, nevertheless, upon the following trusts: To hold, manage, invest and reinvest the same, but investing only in such securities as are legal investments for Massachusetts Savings Banks, and pay over to my said wife the net income therefrom in the quarterly payments, or more often if convenient, during her life. Upon the death of my said wife, Marie Wilcox Fits, said trust shall be continued for the benefit of my grandchildren, John Yatman Lambert, Jr., Robert Fitz Lambert and Marie Marguerite Lambert, all of Los Angeles, California. Said trust fund shall be allowed to accumulate in principal by the addition of interest received thereon until the youngest grandchild shall have attained the age of twenty-one years, then they are to receive an equal share of the net income of said accumulated trust fund thereof during their lives. Upon the death of any grandchild, the trust as to his or her equal proportionate share of the estate shall terminate, and such proportion, discharged of any trust, shall vest in and be distributed to the issue of said grandchild by right of representation, but if such beneficiary leaves no issue, the share of the trust estate theretofore held for his or her benefit shall be held for the benefit of and distributed to the other beneficiaries hereto in the manner, proportions and at the time herein provided. If at the termination of the trust as above provided, there are no issue of any decreased grandchild entitled to such distribution in accordance with the terms of this trust, the entire remaining trust estate, discharged of any trust, shall thereupon vest in and be distributed to my then heirs-at-law in accordance with the laws of the state of my last residence. Such trustees shall make payments of the income quarterly, or more often, if convenient, after youngest grandchild shall have attained the age of twenty-one years. 4.
