SB 982 WOULD IMPOSE...

eOne year in prison for not disclosing your HIV
status, even if you have protected sex.

-I'wo to four years in prison for not disclosing your
HIV status before having unprotected sex, even orally.

eLife imprisonment for people convicted of inten-
tionally exposing another to HIV.

ALL OF THESE PUNISHMENTS CAN BE IN-
CREASED IF "ACTUAL" TRANSMISSION OF
HIV IS PROVEN.

BELIEVE IT OR NOT

This bill has passed the Caliomia Senate and 1s close to
passing in the Assembly.

The reality is that people with HIV and AIDS have sex
just like everybody else, and the only solution is that
everyone be self aware when it comes down to how they

have sex.

HAVING HIV YOU WILL BE AFFECTED
UNDER THIS BILL!

Under SB 982, if accused of "exposing" another to HIV
you can be hauled into court, charged. forced to be
tested, and exposed to the media. Your accuser does
not have to prove transmission!

(Imagine, if you are HIV positive or EVEN if vou are
negative...a disgruntled lover can claim ignorance of
your Status, or that you did not fully "disclose" as the bill
requires.)

JUDICIAL POWER IN YOUR BEDROOM

Not only is SB 982 an attack on individual privacy but it
gives the judicial system the power to supoena, issue

warrants, and order survaillance of what you do in your
bedroom.

Also, the statute of limitations does not start until your
partner claims exposure to HIV or transmission, which
could be years and/or many sex partners later.

BAD PUBLIC POLICY

°SB 982 will discourage voluntary HIV testing by
making it a crime to "know, but not tell, your status’
to potential sex partners. At the same time, it will
legitmize forced HIV testing of those accused of
violating the bill.

THE THREAT OF PROSECUTION DOES NOT
PREVENT AIDS. IT IS EVEYONE'S RESPONSI-
BILITY TO HAVE PROTECTED SEX WITH
PARTNERS WHO ARE HIV - OR HIV+.

Express your opposition to SB 982 to the Public Health
and Safety Committee. Contact these committee mem-
