POLICE COMPLAINTS PROCEDURES AND RIGHTS
OF A PERSON MAKING A COMPLAINT
To the Complainant: ·

This statement briefly sets out the procedures that will be followed upon receipt of your complaint against a member
of a Police Force and your rights under the Police Services Act, 1990.
Who Sees Your Complaint
1. No matter where your complaint is lodged, a copy of the complaint will be sent to the Public Complaints Investigation
Bureau (the Bureau) of the involved Police Force and to the civilian Police Complaints Commissioner.
2. The police officer(s) concerned will be informed of the substance of the complaint unless to do so would prejudice
the investigation.
Informal Resolution
3. Attempts to resolve your complaint informally can be made by the Bureau, before the Chief of Police makes a
decision under Section 90 or by the Police Complaints Commissioner after that time. No complaint can be resolved
informally unless both you and the police officer(s) concerned agree in writing to the resolution. As well, if a board
of inquiry has commenced, the consent of the board of inquiry is required.
4.
Investigations and Reports
In most cases, the bureau will initially investigate the complaint pursuant to the procedures set out in the Regulations
to the Act. In certain situations, the Police Complaints Commissioner may decide to take over the investigation before
the Bureau completes its investigation, in which case you will be notified.
5. You will receive a report approximately thirty days after you make your complaint and on a monthly basis thereafter
unless the investigation of the complaint might be prejudiced by so doing. The Police Complaints Commissioner
will also receive a copy of these reports.
6. If at any time you are not satisfied with the manner in which your complaint is being handled, you may contact
the Office of the Police Complaints Commissioner.
7. When the Bureau investigation has been completed, a final report will be sent to you, the Police Complaints
Commissioner, the Chief of Police and the police officer(s) '?oncerned.
Decision of the Chief of Police
8. After reviewing all investigation reports, the Chief of Police, or his or her designate shall,
(a) decide that no further action is necessary;
(b) admonish the police officer regarding the matter in accordance with subsection 59(1);
(c) hold a disciplinary hearing under section 60;
(d) order that all or part of the complaint be the subject of a hearing by a board of inquiry; or
(e) cause an information to the laid against the police officer(s) and refer the matter to the Crown Attorney
for prosecution.
If the Chief decides to hold a disciplinary hearing under section 60 or orders a hearing by a board of inquiry he
or she at the same time may cause an information to be laid against the police officer(s).
9. You will be informed in writing of the decision made by the Chief of Police.

Review by the Police Complaints Commissioner
10. If you are not satisfied.with any of the following decisions, you may, within thirty days of notification of the decision,
request the Police Complaints Commissioner to review:
(a) the decision of the Chief of Police that no further action is necessary;
(b) the decision of the Chief of Police to admonish the police officer regarding his or her conduct; :: :
(c) the decision of the Chief of Police under section 85 that the complaint or part of it not be further dealt with; .

11. Upon receipt of your request, the Police Complaints Commissioner will review the matter, conducting further
investigation if necessary. The Commissioner's staff have broad powers to investigate. Documents must be made
available and individuals can be subpoenaed to answer questions. · ,. ·
12. After the review, the Police Complaints Commissioner may order a hearing before a civilian board of inquiry when
the Commissioner believes it to be necessary in the public interest. If the Commissioner decides that there should
. not be a hearing, you will _ receive written reasons. Regardless of whether or not misconduct is determined, the
Police Complaints Commissioner has statutory power to make recommendations to police management
suggesting changes to police practices or procedures. The Police Complaints Commissioner will notify you, the
Chief of Police and the police officer(s) concerned about the decision.
Board of Inquiry Hearings
13. If a board of inquiry hearing is ordered, you will be notified in writing of the date and place of the hearing. You

· have the right to attend and take part in the hearing and to be represented by counsel or agent. You will also be .
given an opportunity, prior to the hearing, to examine any physical or documentary evidence or any report that
will be given in evidence at the hearing. The hearing will be open to the public. You will receive a copy of the board's
decision. The decision of the board of inquiry may be appealed to the Divisional Court .

Title Los Angeles Webster Commission records, 1931-1992 
Description Chaired by former federal judge and FBI and CIA Director William H. Webster, the Los Angeles Webster Commission assessed law enforcement's performance in connection with the April, 1992 Los Angeles civil unrest. The collection consists of materials collected and studied by the Commission over the course of its investigation. Materials pertain to both the Los Angeles incident specifically, and civil disturbance, civil unrest control, and policing tactics in general.

Included in the collection are the following: interviews with LAPD officers, law enforcement personnel, government officials, community leaders, and activists; articles, broadcasts, and press releases covering the civil unrest; various tactical and contingency plans created for disasters and emergencies; reports, studies, and manuals about civil unrest control and prevention; literature about community-based policing strategies; emergency plans and procedures developed by other cities; and after-action reports issued once the civil unrest had subsided. Also featured are items related to the internal operations of the LAPD both before and during the civil unrest, including activity reports, meeting agendas and minutes, arrest data, annual reports, curricula and educational materials, and personnel rosters.
