tive positions, subject to all the civil service provisions of this Charter. They shall be deemed qualified for their respective positions under such civil service provisions, and their seniority in such civil service shall date from the time of acquisition of such utility; provided, however, that no person not a citizen of the United States shall be so retained and employed, and that persons so retained and employed shall, within three (3) months from and after the effective date of this amendment or within three (3) months after such acquisition, if such acquisition takes place subsequent to the effective date of this amendment, conform to any residence requirements applicable to employees of said City or department in like positions. Proposed Charter Amendment No. 12 The Charter of the City of Los Angeles is hereby amended by amending Section 391 of Article XXVIII of said Charter to read as follows: Sec. 391. (1) All purchases of materials or supplies involving an expenditure of One Thousand Dollars ($1000.00) or less, required for any board, officer, or employee of the City, excepting purchases requiring payment from the harbor revenue fund, the library fund, the power revenue fund or the water revenue fund, or from any bond funds controlled by the Harbor, Library or Water and Power Departments, shall be made from the lowest responsible bidder, by the Purchasing Agent of the City, upon requisition delivered to him and signed by the department, officer or employee for whom the purchase is to be made. (2) All such purchases involving an expenditure in excess of One Thousand Dollars ($1000.00) shall be made from the lowest responsible bidder by the Purchasing Agent, upon such requisition, provided that in this case the specifications on which bids were asked must first have been approved by the Purchasing Agent and also by the department, officer or employee for whom the purchase is being made, and provided, further, that the acceptance of any bid in such case shall be approved by the Purchasing Agent and by the department, officer or employee for whom the purchase is being made. (3) Whenever the procedure prescribed by this section cannot be followed without loss to the City, any board, officer or employee of the City mentioned in Sec. 351 of this Charter may purchase materials or supplies required for immediate use by the City, when such purchase does not exceed Twenty-five Dollars ($25.00) ; provided, that such emergency purchases shall not exceed One Hundred Dollars ($100.00) for any such board, officer or employee during any one month. (4) The Council may by ordinance provide that the Purchasing Agent may, in his discretion, issue blanket purchase orders not exceeding Five Hundred Dollars ($500.00) each for any calendar month, which shall be authority to make purchases thereunder, to any department, officer, or employee specified in any such blanket order, such department, officer or employee having budget authority to incur such expense when the business of said department would suffer loss and injury from the lack of such blanket purchase order. Proposed Charter Amendment No. 13 The Charter of the City of Los Angeles is hereby amended by adding Section 377 to Article XXVIII, the same to read as follows: Sec. 377. No liability shall exist against any Commissioner or other officer of the City by reason of any official act of such Commissioner or other officer resulting in the illegal expenditure of funds of the City under the control of the Board of which such Commissioner may be a member, or other officer, provided that any such act is performed without fraudulent intent and in good faitb, and the legality of any such expenditure shall have been approved in writing by the City Attorney, in person or by duly authorized assistant or deputy. 46 Proposed Charter Amendment No. 14 The Charter of the City of Los Angeles is hereby amended by adding Section 378 to Article XXVIII, the same to read as follows: Sec. 378. At the end of each fiscal year, the Council shall require the income and expenditures of each Department of the City to be audited by one or more certified public accountants, who are not connected with the City government. Such accountant or accountants shall make his or their report direct to the Council. The Council shall determine the extent of such audit as to each of the several Departments, and may provide for the taking of the same by resolution. Proposed Charter Amendment No. 15 The Charter of the City of Los Angeles is hereby amended by amending Section 28 of Article III, the same to read as follows: Sec. 28. No member of the Council shall be financially interested, directly or indirectly, in any contract or transaction to which the City is a party. No City official shall be financially interested, directly or indirectly, in any contract or transaction to which the City or any department, board or officer thereof is a party and which comes before said official, or the department of the City with which he is connected, for official action. Any contract or transaction hereinabove mentioned in which any official of the City shall be or become financially interested shall become void at the election of the City, to be declared by resolution of the Council, or in the case of contracts made by departments having control of their own funds by resolution of the board in control of such department. No City official shall be deemed to be financially interested, within the meaning of the foregoing provisions, in any contract made with a corporation, by reason of the ownership of stock in such corporation, unless said stock so owned by him shall amount to at least three per cent (3%) of all of the stock of such corporation issued and outstanding. No City official shall vote on or participate in any contract or transaction in which he is directly or indirectly financially interested, whether as a stockholder of the corporation or otherwise; provided, however, that if a corporation is a party to any transaction with the City or with any department, board or officer thereof, such City official may vote on or participate in any such contract or transaction, if such City official does not own, directly or indirectly, stock in such corporation in excess of one per cent (1%) of its issued and outstanding capital stock. If any official of the City shall, during the term for which he was elected or appointed, vote on or participate in any transaction in violation of the foregoing, he shall, upon conviction thereof, forfeit his office and be punished for misdemeanor. Proposed Charter Amendment No. 16 The Charter of the City of Los Angeles is hereby amended by adding Section 146 to Article XI, and Section 229 to Article XXII, the same to read as follows: Sec. 146. Notwithstanding the provisions of Section 71 of this Charter, each member of the Board of Harbor Commissioners shall receive as compensation the sum of Twenty Dollars ($20.00) for each meeting of the Board attended, not exceeding, however, the sum of Two Hundred Dollars ($200.00) in any one calendar month. Sec. 299. Notwithstanding the provisions of Section 71 of this Charter, each member of the Board of Water and Power Commissioners shall receive as compensation the sum of Twenty Dollars ($20.00) for each meeting of the Board attended, not exceeding, however, the sum of Two Hundred Dollars ($200.00) in any one calendar month. 47
