Personnel Complaint Page 7 8.2 Diethrich 'supports Ramirez. She heard Pellegrino state something to the effect of "Chico wants to be a Mexican but he is a Jew." . Payne, Watts, G. Hall, Holcomb, Karlson, Michelena. Montgomery, Mount, Tortorici. Tvndall and Lieutenant Hall deny being present when the statement was made and deny every hearing the statement. Pellegrino denies making the statement. There is sufficient evidence that a statement similar to "Howard Schrieber is whose father?" was written on a chalk board in the O.I.S. office. The investigation also established that Howard Schrieber is listed on Ramirez' birth certificate as his father. Ramirez is supported by civilian witness Diethrich that Pellegrino made a improper remark to Pellegrino. Although Ramirez alleges that the statement was made in front of tf*l* ^ entire section, all other detectives deny hearing the remark. The source of the writing on the black board was not resolved. It is recommended that Count No. 11 be classified as SUSTAINED against Pellegrino. COUNT NO. 12 The Department alleges that sometime in February 1988, Lieutenant Hall failed to take appropriate action after he knew or should have known that one of his subordinates had directed an improper remark toward another subordinate. Ramirez alleged that Lieutenant Hall was present when Pellegrino made the improper remark. (Count No. 11) Diethrich recalls hearing the improper remark but does not remember Hall being present. All other section members refute the allegation. Lieutenant Hall denies the allegation. There are no witnesses to support the allegation. Diethrich cannot remember Lieutenant Hall being present when Pellegrino made the remark. The lack of support for the allegation and Lieutenant Hall's denial leave this count unresolved. It is recommended that Count No. 12 be NOT SUSTAINED against Lieutenant Hall. COUNT NO. 13 The Department alleges that on May 24, 1988, at approximately 1515 hours, Detective Pellegrino, while on duty, unnecessarily became involved in a physical altercation with Ramirez.

Description | Los Angeles Police Department personnel complaint, 1989 April 17, against Elmer Pellegrino, John Tortorici, Carlos Ramirez, Charles Massey, Wallace Montgomery and William Hall. PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
