Personnel Complaint Page 6 8.2 Detective Tyndall did not see the incident but supports Montgomery and Pellegrino by his recollection of incidents leading up to the disturbance. Pellegrino denied the allegation. The investigation established that a physical incident occurred between Pellegrino and Ramirez at a social function in 1987 but did not clearly fix the date of occurrence. Ramirez' version is in conflict with Pellegrino and Montgomery who are partially supported by the civilian witnesses version in that Pellegrino did not apply a chokehold and did not throw Ramirez against a bar stool. Pellegrino admits placing one hand on each of Ramirez' shoulders and moving Ramirez out of his way. Lieutenant Hall observed Ramirez leaning against the wall next to a chair. Montgomery and the two civilian witnesses observed Ramirez pushed against the wall and than sink to the floor. Montgomery, Pellegrino and Tyndall describe the conduct of Ramirez prior to the incident as contributing to the action taken by Pellegrino. The investigation fails to resolve this allegation. It is recommended that Count No. 9 be classified as NOT SUSTAINED against Pellegrino. COUNT NO. 10 The Department alleges that sometime in 1987, Lieutenant Hall failed to take appropriate action after he knew, or should have known, that one of his subordinates had unnecessarily used physical force against another subordinate. Ramirez made the allegation. Pellegrino admits physical conduct with Ramirez but was not aware of Lieutenant Hall's presence. Lieutenant Hall denies that he was aware of any incident between Pellegrino and Ramirez. Count No. 10 is based on the activity alleged in Count No. 9. Count No. 9 established the physical contact between Pellegrino and Ramirez but the actual circumstances were not resolved. There is no resolution of the allegation against Lieutenant Hall either. It is recommended that Count No. 10 against Lieutenant Hall be classified as NOT SUSTAINED. COUNT NO. 11 The Department alleges that sometime in February 1988, Detective Pellegrino, while on duty, directed an improper remark to Detective Ramirez by stating, "Chico wants to be a Mexican but he is a Jew. PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
