PERSONNEL COMPLAINT, LA. NO. 86-600 Page 227 Tyndall stated that during the time he (Tyndall) was assigned to the O.I.S. Section, he never recalled hearing Tortorici state words to the effect, "Hey Mexican, this conversation is for White guys. No one is speaking to you. You speak when your spoken to Mexican." Nor did he recall hearing Tortorici state anything similar to Ramirez such as, "Hey Mexican line five is for you", or "I don't like you Mexican. I never did and I never will." To his knowledge neither he nor anyone else in the office ever directed racially derogatory remarks to Ramirez. Tyndall stated that he did not recall ever overhearing Michelena ask Tortorici if he was going to treat minorities better since becoming a D7III. Nor did he overhear Tortorici ever refer to Michelena as a, "fucking Mexican." Tyndall stated that he recalled overhearing discussions in the office pertaining to a homicide conference that took place in San Francisco in March of 1989. The discussion concerned a presentation given by a CHP investigator of O.I.S.'s and some discussion about the weather in San Francisco. He (Tyndall) specifically denied ever overhearing Lieutenant Hall state to Holcomb that his (Holcomb) partner Karlson.had got a, "light skinned nigger," at the conference. Nor did he recall ever hearing Lieutenant Hall use the term, "nigger toe." He stated that he did not place any photographs of Black females over the pictures of Karlson's family that were located on Karlson's desk nor did he see anyone else do so. He further denied that he pointed out to Lieutenant Hall any photographs of females, Black or otherwise, on Karlson's desk and denied that he ever heard Lieutenant Hall refer to any photographs by stating, "These are too Black. She was a light skinned nigger." He (Tyndall) denied that he ever stated regarding Karlson or any other member of the O.I.S. Section, "He's going to have to check himself out for sickle cell." He did not recall Pellegrino saying over the Tac frequency, "4-King 90 boy 4K24, are you going to make a side trip to Nickerson Gardens?" Tyndall stated that he never heard Montgomery state to Michelena or anyone else, "You know how you Mexicans lie all the time." He could not recall Montgomery or anyone else using any racially derogatory terms toward anyone in the office. Tyndall stated that he was not aware of any instance where Lieutenant Hall failed to follow established Departmental rules, regulations, and policies in carrying out his duties as a member of the Department. Bova), re I.A. no. 86-600: Department complaint alleging unbecoming conduct against Detective III Elmer Pellegrino (serial no. 12470), Detective III Wallace Montgomery (serial no. 16136), Detective III Carlos Ramirez (serial no. 13427), Lieutenant II Charles Massey (serial no. 11880), and an unknown officder, Robbery Homicide Division (RHD); Department complaint alleging unbecoming conduct and neglect of duty against Lieutenant II William Hall (serial no. 13726, RHD. PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
