PERSONNEL COMPLAINT, LA. NO. 86-600 Page 22 6 Tyndall further stated that he never heard Pellegrino state in reference to Ramirez, "I got to choke me out a Mexican," or anything similar to that. Tyndall stated that he denied seeing the sentence, "Howard Schreiber is whose father?" written on the blackboard in the O.I.S. Section office. He denied that he wrote the comment on the blackboard and was not aware of anyone else who might have done so. Nor did he recall overhearing Pellegrino state "Chico wants to be a Mexican but he is a Jew." He likewise did not hear Lieutenant Hall state in response to any writing on a blackboard, "Well it looks like someone has dug up dirt on a D-III candidate." Tyndall stated he could not recall ever being present and observing a conversation between Lieutenants Hall and Massey when they were reviewing a captain's promotional list. He denied ever hearing Hall state to Ramirez, "God damn it Chico, you are interrupting us," or at any other time hearing Lieutenant Hall direct profanity toward Ramirez or speak to him in a degrading or derogatory manner. Tyndall stated that neither in December of 1988 nor at any other time when he might have been present did he hear Montgomery tell anyone, including Fiderio, to, "Just ignore the little Mexican. Don't pay attention to him," in reference to Ramirez. He did not recall ever hearing Montgomery ask Michelena, "How can a preppy Mexican like you have a dumb ghetto Mexican for a relative?" or Montgomery stating to Michelena, "Rios lives in a dump like typical Mexicans." He (Tyndall) knew who Rios was. He believed he was the brother of Michelena's sister's husband and had been involved in an O.I.S. Tyndall stated that he never heard Tortorici refer to Ramirez or anyone else as a, "greaser," or, "greaseball." He specifically denied overhearing Tortorici discuss a 1989 weekend duty schedule with Ramirez and denied ever hearing Tortorici state to Ramirez, "Hey greaser, there is only one good thing about the schedule. I don't have any weekends assigned with you. That's good because I don't have to work with you, greaseball." Tyndall stated he never heard Pellegrino refer to Laura Diethrich as a, "dumb Mexican broad", or state that if it was up to him he would, "fire the bitch." Tyndall stated that he did not recall any incident involving Ramirez, Greg Hall, Pellegrino, and Lieutenant Hall and a measure meter.

Bova), re I.A. no. 86-600: Department complaint alleging unbecoming conduct against Detective III Elmer Pellegrino (serial no. 12470), Detective III Wallace Montgomery (serial no. 16136), Detective III Carlos Ramirez (serial no. 13427), Lieutenant II Charles Massey (serial no. 11880), and an unknown officder, Robbery Homicide Division (RHD); Department complaint alleging unbecoming conduct and neglect of duty against Lieutenant II William Hall (serial no. 13726, RHD. PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
