PERSONNEL COMPLAINT, I.A. NO. 86-600 Page 170 of his,subordinates had become involved in an on-duty altercation as this was not the case in that Ramirez' and Pellegrino's actions were all done kiddingly and the incident was stopped before it became something more serious. Nuckles further stated that he did not recall seeing Pellegrino throw any objects across the room but it could have happened and he just could not recall. Similarly, he could not recall if Ramirez brushed any objects off Pellegrino's table. Also, he could not recall Ramirez' back striking any objects on Bud Watts' table but there were various objects on the table such as a stapler, telephone, and a picture frame. Nuckles stated that within a day or two after the incident with Ramirez and Pellegrino, he saw a miniature baseball helmet on Ramirez' desk. Nuckles did not see who gave it to Ramirez but Ramirez told him that Lieutenant Hall gave it to him. Ramirez told him (Nuckles) that when Lieutenant Hall gave it to him, he told him to use it if he was going to mess with Pellegrino. Ramirez appeared displeased by Lieutenant Hall's comments but Nuckles could not recall specifically what Ramirez was upset about. Nuckles stated that Ramirez might have been over sensitive to the Lieutenant's comments because Ramirez had said that Lieutenant Hall had embarrassed him at some shooting scenes in the past by directing him in front of others to not do things the way he (Ramirez) had been accustomed to doing regarding officer-involved shooting investigations. In Nuckles' opinion, Ramirez and Lieutenant Hall were dissimilar in personality and that, coupled with Ramirez feeling that Lieutenant Hall had embarrassed or shown a lack of faith in him in the past, made him over sensitive to the baseball helmet comments. Nuckles stated that he had no recollection of Lieutenant Massey ever calling Ramirez a "little Mexican asshole", or Ramirez ever challenging Massey over anything.

Bova), re I.A. no. 86-600: Department complaint alleging unbecoming conduct against Detective III Elmer Pellegrino (serial no. 12470), Detective III Wallace Montgomery (serial no. 16136), Detective III Carlos Ramirez (serial no. 13427), Lieutenant II Charles Massey (serial no. 11880), and an unknown officder, Robbery Homicide Division (RHD); Department complaint alleging unbecoming conduct and neglect of duty against Lieutenant II William Hall (serial no. 13726, RHD.
