PERSONNEL COMPLAINT, LA. NO. 86-600 Page 169 Pellegrino weare only engaged in horseplay. Nuckles stated that after Pellegrino had held Ramirez down on the table for a short time, Ramirez expressed a desire to get up and attempted to do so but Pellegrino still held him down. At that point, Nuckles thought the incident was on the verge of getting out of hand and told Pellegrino and Ramirez to "knock it off" or words to that effect and walked over to their location. As Nuckles arrived at their location, Pellegrino backed off letting go of Ramirez and Ramirez got up off the table. The entire incident lasted ten to. fifteen seconds. Nuckles stated that after Ramirez got up, he appeared upset about the incident and his watch being broken. Pellegrino was quiet and sat at his table as did Ramirez after looking around the office for a part that came off his watch. Ramirez remained in the office for ten to fifteen minutes afterwards and then went end-of-watch. Nuckles stated that aside from a small cut to one of Pellegrino's finger, he did not see any evidence of injury to Ramirez or Pellegrino and neither ever complained of any to him. He did not observe Ramirez or Pellegrino punch, slap or kick during the incident, nor did he recall any threats of harm made by either Ramirez or Pellegrino. Nuckles specifically could not recall Pellegrino stating, "I'll beat the shit out of you, you little fucking Mexican. I'll kill you". If it was said, it was done kiddingly as all the comments were during the incident. Nuckles stated he would not characterize the incident as an altercation; it was just "horseplay". Nuckles"did not see anything about the incident as misconduct because it just appeared to be office "skylarking". Nuckles stated the he understood that Pellegrino called Lieutenant Hall about the incident later in the evening but Nuckles did not overhear the conversation and did not know how Pellegrino characterized it to Lieutenant Hall. However, the day after the incident, Nuckles discussed it with Lieutenant Hall and told him Ramirez and Pellegrino had just been involved in horseplay that almost got out of hand but it had been stopped before it did. He further told Hall that Pellegrino had telephoned Ramirez at home and apologized to him and Ramirez accepted the apology and they considered the incident over and done with. Nuckles could not recall if he gave Hall any further details of the incident. This, Ramirez receiving the phone call from Pellegrino, had been related to Nuckles in a telephone conversation he had with Ramirez at around 1900 hours the day of. the incident. Nuckles could not recall any other details of the phone conversation he had with Ramirez except for some possible conversation about a spring being missing from Ramirez' watch. Nuckles stated that he did not counsel Ramirez or Pellegrino and was not aware of anyone else doing so, nor did he or anyone else document the incident.
