Montgomery did not recall who told him what the helmet stood for nor did he know how the helmet got on Ramirez' desk. Montgomery denies ever hearing Lieutenant Hall say to Ramirez that he could use the helmet as protection against Pellegrino if he became violent. Montgomery said that he never heard Lieutenant Massey say to • Ramirez, "How's the little Mexican asshole doing?", or of Ramirez challenging Lieutenant Massey, and if that had occurred, he would have heard about it. Montgomery said no such statement was ever made by Lieutenant Massey. Montgomery was interviewed on June 6, 1989, 0915 hours, at Robbery-Homicide Division, by Lieutenant S. Coker, Serial No. 20195 and Sergeant M. Cotwright, Operations-Headquarters Bureau. Sergeant H. Ryon acted as Montgomery's employee representative. Montgomery stated that he was assigned to the O.I.S. Section on March 8, 1981. Montgomery stated he never heard Lieutenant Higbie state in his presence, "We don't need a nigger or a broad here. We already have a Mexican. That 's enough, right Chico?" Nor did he hear Higbie express any similar sentiment in other words. He also denied being aware of any policy within the O.I.S. Section to preclude minorities from assignment in the O.I.S. Section. He never heard Higbie threaten Ramirez in any way. Specifically he did not recall hearing Higbie threaten to, "Rip" Ramirez' lips off. He never heard Higbie use the term, "nigger," nor did he ever hear anyone else in the unit use.such a word. Montgomery stated that Salkeld and Muldrew left the unit for deficiencies in their work performance. He was not aware of any non-job-related situation that might have existed between them and Higbie that could have resulted in their removal from the O.I.S. Section. Montgomery stated he was not aware of Pellegrino ever receiving compensation he was not entitled to for overtime and he never heard Lieutenant Higbie, Lieutenant Hall or Captain Gartland discuss with Pellegrino his working excessive overtime. Montgomery stated he never observed Pellegrino apply a chokehold on Ramirez and never heard Pellegrino state to Ramirez, "Let me show you what I used to do to little fucking Mexicans on the street," or anything similar. If the aforementioned had occurred in his (Montgomery) presence, he would have recalled.
