PERSONNEL COMPLAINT, LA. No. 86-600 Page 145 Michelena stated that sometime in November, 1987, upon entering a PAB elevator, he observed Sergeant Sergio Diaz. Michelena said Diaz asked him what was wrong with Ramirez. Diaz said he had called Ramirez "Chico" and he (Ramirez) flew off the handle. Michelena said although Diaz did not go into any details, he (Michelena) interpreted the conversation between Ramirez and Diaz as a confrontation. Michelena did not recall if Diaz said that he had been threatened in any way by Ramirez. Michelena stated he did not attend an O.I.S. Section Christmas 1987 luncheon at Tex Taylor's Restaurant. Michelena said he was sure the O.I.S. Christmas 1987 luncheon was held at Columbo' Restaurant in Northeast Division. Michelena did not recall anything significant occurring at the luncheon. Michelena said he was aware of a retirement luncheon at Tex Taylor's Restaurant where Ramirez had had a couple of drinks. Michelena said he had heard that Ramirez had become excited and was walking around poking people in the chest. Michelena said that he was told that Ramirez had poked Pellegrino in the chest and Pellegrino had put a stop to Ramirez' actions. Michelena said that Montgomery had related the incident to him but had not provided him with any specific details. Michelena stated at no time in February, 1988, or at any other time did he observe Pellegrino or anyone else write on the blackboard in the O.I.S. office, "Howard Schreiber is whose father." Michelena denied hearing Lieutenant Hall say to Ramirez, "Well it looks like someone has dug up some dirt on a Detective III candidate." Michelena denied hearing Pellegrino say, "Chico wants to be Mexican but he is a Jew." Michelena stated at no time during December, 1988, or at any other time did he hear Montgomery say to Fiderio from SID in referring to Ramirez, "Just ignore the little Mexican. Don't pay attention to him." Michelena stated that he recalled an O.I.S. that occurred in December 1988. Michelena recalled a conversation that took place between he, Montgomery and Tyndall regarding an Officer Rios who had been involved in the O.I.S.. Michelena said that Officer Rios was his brother-in-law's brother. Michelena denied that Montgomery said, "How can a preppy Mexican like you have a dumb ghetto Mexican for a relative." Michelena said that Montgomery often refers to him as being "preppy" -because he wears dress shirts with button-down collars but that Montgomery has never referred to him as a preppy Mexican. Michelena denied that he said "Rios belongs to the other side of the family that is not doing well". Michelena denied that Montgomery said "Rios lives in a dump like typical Mexicans."

PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
