PERSONNEL COMPLAINT, I.A. No. 86-600 Page 81 DIETHRICH. LAURA. HEARING REPORTER.. SERIAL NO. A-8288. ROBBERY-HOMICIDE DIVISION (RHD). 485-6475 Laura Diethrich was interviewed on May 1, 1989, at 1127 hours, at Robbery-Homicide Division by Lieutenant II Stephen Coker, Serial No. 20195 and Sergeant I Marty Cotwright Serial No. 20132, Operations-Headquarters Bureau. Diethrich stated that she was seated at the computer terminal which was south of her desk, in the outer office of the O.I.S. Section, and that she was working on the computer, when Ramirez came through the office. Diethrich did not recall whereoRamirez had come from, and that she had completed an O.I.S. report for Ramirez and handed it to him, and that Ramirez then walked into the O.I.S. squad room. Diethrich said a short time later, she heard some loud bickering between Pellegrino and Ramirez, and the sound of papers flying. . . Diethrich said that she heard Ramirez say, "Don't do that man, she just finished typing that report". Diethrich said that as she stoop up and turned in a southeasterly direction, she was about eight feet from a convex mirror that is located just above the doorway that leads from Room 311 which is the outer office of the O.I.S. squad room into Room 312 which is the O.I.S. squad room. Diethrich said that she heard a loud slamming sound, like someone or something hitting a file cabinet or a table at the east end of the squad room. Diethrich looked into the mirror and observed Pellegrino and Ramirez involved in a physical altercation, and that Pellegrino was in such a position that he was standing over Ramirez, who was leaning backwards, with his buttocks resting on the edge of Detective Watts* table. Diethrich said Watts' table was adjacent to Ramirez' and Pellegrino's table. Diethrich said at no time did she observe Ramirez' back down on the desk or hear him yell out in pain; other than a small scratch on Ramirez wrist, she did not observe any injury to Ramirez. Diethrich said that she did not observe either Pellegrino or Ramirez throw any punches or kicks, nor did she observe Pellegrino's arms around Ramirez at anytime. She said that Pellegrino and Ramirez were holding onto one another and pushing and tugging at each other's clothing, and it appeared they were wrestling with each other. Diethrich further stated she did not characterize the incident as horseplay, because at other times, she had seen horseplay, bickering, pushing and shoving, but what she had seen Pellegrino and Ramirez involved in, was a fight. Diethrich said that prior to the end of the altercation, she became too upset to continue to watch, so she turned and moved away from the mirror, back to another part of the outer office, and that she heard another slamming sound, and Detective Montgomery say, "Hey you guys cut it out".
