PERSONNEL COMPLAINT, I.A. No. 86-600 Page 59 because he wanted Laura to remain happy while working in the OIS Section. In addition, he did not come back to the office and throw a book on the desk and announce, "that she won't lie," in reference to Laura Diethrich after the meeting with her husband. The Department alleged that during the period from March of 1981 to April of 1989, Detective Montgomery directed improper remarks to Detective Ramirez by .referring to him as, "the token Mexican," in the OIS Section. Det. Ramirez stated that he recalled Montgomery had referred to him as the "token Mexican" in the OIS Section, on various, dates and times but he could not provide any specifics. Montgomery while engaged in conversation in the office would say to others, "Yeah, we have our token Mexican in the unit." Montgomery would point in his direction and say, "that's him" or words to that effect. He could not recall who Montgomery had been talking to on those various occasions when he referred to him (Ramirez) as the "token Mexican". Note: None of the personnel interviewed who were assigned to the OIS Section during the time frame of the allegation recalled hearing Montgomery refer to Ramirez as a, "token Mexican". Montgomery denied the allegation. He stated he never referred to Ramirez as the, "token Mexican," in the OIS Section.

Bova), re I.A. no. 86-600: Department complaint alleging unbecoming conduct against Detective III Elmer Pellegrino (serial no. 12470), Detective III Wallace Montgomery (serial no. 16136), Detective III Carlos Ramirez (serial no. 13427), Lieutenant II Charles Massey (serial no. 11880), and an unknown officder, Robbery Homicide Division (RHD); Department complaint alleging unbecoming conduct and neglect of duty against Lieutenant II William Hall (serial no. 13726, RHD. PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
