PERSONNEL COMPLAINT, I.A. No. 86-600 Page 2 7 fist. Ramirez wasstill on his back when he struck Pellegrino. Pellegrino appeared surprised by the blow and continued stepping back about four or five feet. He (Tyndall) then walked over to Pellegrino's location and Nuckles went to Ramirez who then got up. The entire incident lasted about fifteen seconds. He observed no evidence of injury to either Ramirez or Pellegrino. After. . they separated, Ramirez and Pellegrino returned to their desk and sat across from each other. A few minutes later, Ramirez left the office for home. Tyndall stated he did not recall hearing Pellegrino say that he had to straighten out his Mexican partner. He did not recall Pellegrino stating, "I'll beat the shit out of you, you little fucking Mexican. I'll kill you." If Pellegrino had made such a statement, he (Tyndall) would have recalled it. Detective Hall stated that while seated at his desk, he looked up and saw Ramirez, who was about five to six feet to his left, standing over Pellegrino who was seated at his desk, and that words were being exchanged. He could not recall any specific conversation but the tone was such that he thought they were joking. He (Hall) then went back to what he had been doing. The conversation then got louder and that when he looked up again, he observed that Pellegrino and Ramirez were grabbing and pulling at each other's clothing. He could not recall who the aggressor was at that point nor could he recall where each had his hands on the other. Pellegrino then lifted Ramirez up off the floor and placed him down on his (Ramirez) back on an adjoining table. He did not recall how Pellegrino had put Ramirez on the table, except that it was in one continuous motion, and that it was not done in a forceful manner, nor was it a "body slam." Hall further stated that he did not recall hearing Ramirez cry out in pain nor could he recall if there were any objects on the table. As soon as Pellegrino placed Ramirez on the table, Pellegrino backed away and Ramirez got up off the table. At that point, he thought that both Pellegrino and Ramirez had become angry with each other, because their tone of voice and their actions were no longer consistent with kidding around. However, he did not recall any specific words being exchanged between the two. He denied ever seeing Pellegrino or Ramirez attempt to strike one another. At no time during the incident did he recall hearing Pellegrino refer to Ramirez as his "Mexican partner" or hear him say that he was going to straighten Ramirez out. He also denied ever hearing Pellegrino say to Ramirez,"I'11 beat the shit out of you you little fucking Mexican. I'll kill you."

PART OF A SERIES: Materials in the series fall into one of several categories related to the Independent Commission's work product: (1) Commission meeting materials, which include meeting agendas, work plans, memoranda, and articles about police misconduct that were circulated and reviewed during the Commission's internal meetings; (2) public correspondence, which includes citizen complaints against the LAPD in the form of written testimony, articles, and an audio cassette tape, as well as letters drafted by citizens in support of the LAPD; (3) summaries of interviews held with LAPD officers regarding Departmental procedures and relations; (4) public meeting materials, which include transcripts, supplementary documents, and witness statements that were reviewed at the Commission's public meetings; (5) press releases related to the formation and work product of the Commission; and (6) miscellaneous materials reviewed by the Commission during its study, including LAPD personnel and training manuals, a memorandum of understanding, and messages from the LAPD's Mobile Digital Terminal (MDT) system. |
