APPENDIX A ^^ ^^ 159 ness to be issued pursuant to Subsection 18 of this Section 229, the resolution of th'e Board adopted pursuant to subdivision (a) of this Subsection 5 shall take effect upon its adoption by the Board, subject only to the right of referendum herein provided for, and the transmission of such resolution to the offices of the Mayor and City Cerk shall be for information only, and it shall not be subject to disapproval by the Mayor or Council, provided, however, that any such resolution may, by its terms, be made subject to disapproval by the Mayor or Council with the effect provided in subdivision (b) of this Subsection 5. If any resolution transmitted pursuant to this subdivision (c) shall contain a request that the Council submit to the voters of the city the proposition of assenting to the issuance of the bonds therein specified, pursuant to Subsection 17 of this Section 229, the Council shall proceed as in said Subsection 17 provided. Subd. (d). Upon any such resolution taking effect subject to the right of referendum, pursuant to any of the preceding subdivisions of this Subsection 5, the Board shall cause the same to be published by at least one insertion in some daily newspaper published and of general circulation in The City of Los Angeles. At any time within thirty days after such publication a referendary petition, demanding the submission of such resolution to a vote of the qualified electors of the city for their assent to the issuance of the proposed bonds, may be filed with the City Clerk. Except as in this Section 229 otherwise expressly provided, all of the provisions of this charter relating to referendum with respect to ordinances shall apply to any referendum under the provisions of this Subsection 5. Upon presentation to the Council by the City Cerk of a referendary petition, the resolution which is the subject thereof shall be of no effect unless and until the same shall have been assented to by the voters. Subd. (e). If no such referendary petition is presented within the aforesaid period of thirty days, then upon the expiration of said period, or if the proposition of issuing the bonds specified in the resolution of the Board adopted pursuant to subdivision (a) of this Subsection 5 shall have been assented to by the voters, whether upon referendum pursuant to this Subsection 5, or pursuant to any other provisions of this Section 229, then upon such proposition having been so assented to, the said resolution shall take full and final effect, and the Board may proceed in accordance with the provisions of this Section and issue bonds within the terms of said resolution. Sub-sec. 6. Determination and limitation of amounts of issues. Subd. (a). Whenever the Department shall exercise the power to borrow money, or to refund indebtedness, pursuant to this section 229, the Board shall by resolution determine the amount or amounts required for the purposes for which the money is to be borrowed or required for such refunding. Subd. (b). Whenever the Department shall exercise the power to borrow money pursuant to this section 229 the Board may authorize the issuance of bonds in any amount determined pursuant to subdivision (a) next above; provided that no bonds so authorized shall be issued unless the amount of the surplus (including surplus arising from contributions in aid of construction), as of the end of the last fiscal year which ended not less than four months prior to the making, with reference to the bonds so to be issued, of the finding and determination provided for in clause (1) of subdivision (a) of subsection 16 of this section 229, derived from the operation of the works to which pertains the revenue fund out of which the bonds so authorized are to be payable, equals at least seventy percent (70%) of the aggregate of the three following amounts, (i) the amount of the bonds to be so issued, (ii) the amount of the bonds of the Department outstanding at the time of the acceptance of a proposal for the purchase of the bonds so authorized and payable out of that revenue fund, and (iii) the amount of the bonds of the City outstanding at that time and serviced out of that revenue fund.

PART OF A SERIES: A critical component of the Commission's investigation centered on the idea that governance of the LAPD was shared between the Office of the Chief of Police, an administrative body, and the Board of Police Commissioners, a citizen body. To better understand the dynamic between these two entities, the staff of Heller, Ehrman, White, & McAuliffe researched the history of the Los Angeles City Charter, focusing primarily on its provisions regarding the distribution of power and the structure and organization of the LAPD. Included in the series are reproductions of reports, dissertations, article clippings, excerpts from city documents, and charter amendments related to the charter's conception and development over time. The series also includes several summaries of expert witness interviews regarding the effectiveness of this structure. |
