PERSONNEL ^^ ^^ 121 ployees' Retirement System, shall continue in force and effect until changed by the city council by ordinance in accordance with the provisions of this section. In providing pensions and retirement benefits for city employees, the city shall maintain such benefits and related employee contributions at a level as nearly equal as possible to pensions and retirement benefits and related employee contributions prevailing in private and public employment. The council shall not adopt any changes that will reduce the total pensions and retirement benefits existing at the time this charter becomes operative. The city shall at regular intervals complete a survey of pensions and retirement systems for the purpose of determining as nearly as can be ascertained, the level of pensions and retirement benefits and related employee contributions prevailing in private and public employment. The first such survey shall be conducted as soon as practicable after the operative date of this charter. Upon completion of the first survey the council, by ordinance, shall adopt provisions for pensions and retirement benefits and related employee contributions to carry out the requirements of this section. If by the first survey, it is determined that a disparity exists between the city's pensions and retirement benefits and related employee contributions and those in public and private employment, the council may make the changes needed effective over an initial period of 4 years. Thereafter the council shall adopt provisions for pensions and retirement benefits and related employee contributions by ordinances to be effective July 1 of each even numbered year. Section 6.26 Investment Counselling Advice The board shall retain a competent investment counsel or advisor and shall purchase or sell securities, except United States Treasury obligations, only upon the recommendation or advice of such investment counsel or advisor. Section 6.27 Transferability of Benefits The board may by rule provide for transfers of pensions and retirement benefits by employees transferred or promoted from one city department to another.

PART OF A SERIES: A critical component of the Commission's investigation centered on the idea that governance of the LAPD was shared between the Office of the Chief of Police, an administrative body, and the Board of Police Commissioners, a citizen body. To better understand the dynamic between these two entities, the staff of Heller, Ehrman, White, & McAuliffe researched the history of the Los Angeles City Charter, focusing primarily on its provisions regarding the distribution of power and the structure and organization of the LAPD. Included in the series are reproductions of reports, dissertations, article clippings, excerpts from city documents, and charter amendments related to the charter's conception and development over time. The series also includes several summaries of expert witness interviews regarding the effectiveness of this structure. |
