96 CITY GOVERNMENT FOR THE FUTURE Section 2.17 Independent Audit * The city council may require an independent audit of the income and expenditures of the city government or any of its activities. CITY CLERK Section 2.20 City Clerk The city council shall appoint and may remove the city clerk subject to civil service rules. The city clerk shall serve as clerk of the city council, keep the official archives of the city and serve as superintendent of municipal elections. The city clerk shall attend meetings of the council and keep a record of council proceedings. He may administer oaths and affirmations, and shall issue subpoenas upon proper request therefor. Section 2.21 Archives System The city council shall by ordinance prescribe the system for the keeping and management of the official archives by the city clerk. AUDITOR Section 2.30 Auditor The city council shall appoint and may remove an auditor subject to civil service rules. The auditor shall conduct a financial post audit of the activities and operations of the city government. OMBUDSMAN Section 2.40 Ombudsman There is hereby established the office of ombudsman. He shall be appointed by the city council for a term of 8 years. He shall be qualified in accordance with civil service standards, but the office shall be exempt from civil service rules. He may be removed for cause by a 2/3 vote of the city council. Section 2.41 Powers and Duties of Ombudsman The ombudsman shall be responsible for processing citizen complaints that are directed or referred to him. All complaints determined by the ombudsman to be valid shall be processed to conclusion. The ombudsman shall maintain a central grievance file. He shall analyze data on citizen complaints and shall submit reports thereof as directed by the city council. He shall establish and maintain an office for the processing and appropriate referral of requests for information or assistance on any governmental matter regardless of jurisdiction. The ombudsman shall appoint and may remove the members of his staff subject to civil service rules. Section 2.42 Funds for Ombudsman Office The city council shall provide funds for the maintenance and operation of the ombudsman's office in an annual amount not less than the average amount provided for the offices of the members of the city council.

PART OF A SERIES: A critical component of the Commission's investigation centered on the idea that governance of the LAPD was shared between the Office of the Chief of Police, an administrative body, and the Board of Police Commissioners, a citizen body. To better understand the dynamic between these two entities, the staff of Heller, Ehrman, White, & McAuliffe researched the history of the Los Angeles City Charter, focusing primarily on its provisions regarding the distribution of power and the structure and organization of the LAPD. Included in the series are reproductions of reports, dissertations, article clippings, excerpts from city documents, and charter amendments related to the charter's conception and development over time. The series also includes several summaries of expert witness interviews regarding the effectiveness of this structure. |
