Sec. 5. All persons having anv of the cUirn* against
the State of 1'aliroi-nii. entitled to be funded as herein
after specilied. sliall upon the presentation of the samr
to tii-Treasurer of State, receive in exchange therefor
a bond or bonds of the State of California, provided for
in the first section of this Act ; but no bond shall he issued for a less sum than five hundred dollars, nor for
fractional parts ot a hundred dolla s. but the Treasurer
may issue certificates ,,f such fractional parts not bonded, which said certificates shall be transferable and en
lith'd lo be funded as before provided. The Treasurer
-hall endorse, on the back of each laim so received and
liquidated, the dare on which I). received the same
and from whom, and the number of the bond (ssned in
exchange therefor, and such claim shall he tiled in Die

be provided by law for ordinary State taxes, a tax of thirty
cents on each one hnndred dollar* of thfi assessed value
of real and personal property in the State, and the fund
derived from this tax shall be set apart and appointed
exclnsiiety to the payment of the interest on tile bond"
herein provided, and the final redemption of the principal
of sa id bonds, and the faith of t lie State of Cali forma is
hereby pledged for the payment as herein provided of tlie
bonds issued hy virtue of 'his Act, and the interest thereon, and all moneys that may be received by the State of
California from tlie United States Government on account
of the Civil Fund, so called, are hereby irrevocably pledi;
ed to the payment of the principal and interest on the
bonds issued under this Act. V wilful refusal or neglect
by Supervisors or any other officer to levy or cdlect the
tax imposed by this Act. shall he a misdemeanor, and the
person or persons convicted thereof -liatl be removed from
oflice and punished by a fine not e\eeedinif oue thousand
dollars, or by imprisonment in the county jail not exceed
ing -ix months, or by br>tli such line and imprisonment.
Sec. 7. Whenever, on the first day of January or July in
any year, there remains, si fter the payment of the interest as he re in he feii' provided, a surplus of teu thousand
dollars or more, it shall be the d.ity of the Treasurer to
advertise for Ihe space of one week, in one daily newsna
per published in ^*iiglisli. in tne city of N'ew York, and for
one month in one daily neivspa er published in English at
the State Capital, for sealed proposals, to lie opened one
month after the expiration of such publications by the
Treasurer, in presence of the Governor or Comptroller, nt
tlie StateCapital. for the surrender of bonds issued under
this Act, wliich advertisement shall state the amount of
money he lias ou hand for the purpose of redemption, and
ihey shall accept the lowest proposals, at rates t.ot, exceeding par value, as may redeem the greatest amount of
bonds until the amount of cash on hand for redemption
is exhausted ; provided, hoiwi'er, in case a sullicient
amount of such bonds sliail nol he offered as aforesaid, to
exhaust the sinkinc fund to a less amount than ten thousand dollars, then it is hereby made the duty of the Treasurer to advertise in two newspapers, one in New York
and one at the Capital «f this State, for three months,
wliich advertisements shall state the amount, of the sink
ing fund, and the number of bonds numbering them in
ihe order of their issuance, which *aoh fund Is se1 apart
lo pay and discharge ; and if such bonds, so numbered in
• uch advertisements, shall not oe presented for payment
aiul cancellation within three months from the expiration
nf such publication, then such fund sh ill remain in the
Trea- ury to discharge such bonds whenever presented—
but tliey shall draw no interest after such publicsition aa
last aforesaid.
Sec. 8. The Treasurer of State shall keep full and particular account and record of all liis proceeding under this
Act. and of the b nils redeemed and surrendered, aud he
shall transmit lo the Governor an abstract ot all his proceeding . under this Act. with his annua! reoort. to be by

Sec. 9. It shall be the duty of the Treasurer to pay the
interest on e*M bonds when the same falls due, out ol
said interest fund, if sufficient, and if said fund be not
sullicient, then to pay the deficiency out of the General

Sec. 10. It shall be the duty of the Governor and Comp
t roller to attend, at least once a month, at theTreasnrer'?

claims received by Ihe Treasurer as aforesaid, and caust
the same to be registered and cancelled in such mannei
a* to prevent them from being re-issued or put in eir-
culatioi .
-ee. 11. The following are specified is the claims which
are entitle I to be received and funded under this Act:
First. Civil bonds of the Stale issued under the funding
Acts passed in the years 1851,1862, 1868, 1855. and 1856-
which are now outstanding, with interest du on the
•unit when presented, as app»ars by the coupons. Second,
Comptroller's warrants drawn under sanction of law. foi
civil expenses p ior to January Is'. A. D. 1S57. and now
outstanding and unpaid, bu the provisions of this Act
shall not authorize the fun 'ing ot any of those wi
the registration and endorsement of which were cancelled
or required to be cancelled by the provisions of '• A
to cancel the registration and endorsement of certai
rants, and prohibiting the payment of the same
proved January 80th. A. I>. 1856. or war ants which have
bee* sp-cifical'ly adjudged illegal by any Court, and all
■aid warrants speciiled in the last-menth ned Act-, art
hereby expressly excluded from all the benefits ai.d pro
i/isions of this Act. Third. Just or legal claims against
the State accrued prior to January 1st, 1857, and whicli
may lie allowed and audited by Act of the Legi-lalure
And if the Treasurer of State shall wilfully issue bondr
upon claims not herein specified as receivable, it shall be
deemed a misdemeanor, and he sliall be pu ished as pro
vided in sec ion fi of this Act. and such bond shall be void
Sec. 12. The claims specified in this Act may be receive"!
for funding, and bonds therefor may be issued prior to thi
first day of January, 1859. but not afterwards : and al
claims not presented for funding prior to that lime, are
excluded from the provisions of this Act, and such blank
bonds prepared under the provisions of this Act, as shall
then remain on hand, shall be destroyed fn the prsee&cS
nf the Governor. Comptroller snid Treasurer,

be counted returned and canvassed, and declared in the

for the Treasurer of State, and If it appear that a m ijor-
ity ofall the votes socast for or-gainst tbis law. as aforesaid. arein favor nf this Act. then the same sha'l have
effect as hereinbefore provided, and shall he irrepealahle
until the principle rnd interest nf the liabilities herein
created shall he pa-d and discharged, and tbe Governor
shall make proclamation thereof: but if a majority of the
votes no east are against thisAct. then the same shall be-

the eause of bum miiy. Ye.-terday we were permitted to examine those beauti.ul specimens ol
English workmanship, whieh have ,but recently
been received by the Secretary ot the Navy.
The first lhat we looked a' wat tbat given by
tbe British Government to Commander Henry J
Hartstein, wbo commanded the British barqu*
Resolute, recently purchased t»y our Government
d relurned to the British Government. This
is very much admired, and has been pronounced
to be dicidedly the handsomest oi the three. The
hilt is richly chased with gold, and the case in
which it is kept is quite perfect in its arrange*
ment.
The remaining two swords are similar in all
respects, except in the inscriptions, which are as
follows :■■ Presented by the British Government

the United Slates surveying steam vessel Vixen,
in grateful ackuowledgmein of the prompt and
efficient services rendered the Br .list) barque
Adieu. August 14. 1855. ' The heads or the bill*

head ol gold, exquisitely carved, and the guard*

blades are very haudsoirely cai ved and the scabbards of blue velvet mounted with gold.

Whenever, on the first day of January or July in any year, there remains, si fter the payment of the interest as he re in he feii' provided, a surplus of teu thousand dollars or more, it shall be the d.ity of the Treasurer to advertise for Ihe space of one week, in one daily newsna per published in ^*iiglisli. in tne city of N'ew York, and for one month in one daily neivspa er published in English at the State Capital, for sealed proposals, to lie opened one month after the expiration of such publications by the Treasurer, in presence of the Governor or Comptroller, nt tlie StateCapital. for the surrender of bonds issued under this Act, wliich advertisement shall state the amount of money he lias ou hand for the purpose of redemption, and ihey shall accept the lowest proposals, at rates t.ot, exceeding par value, as may redeem the greatest amount of bonds until the amount of cash on hand for redemption is exhausted ; provided, hoiwi'er, in case a sullicient amount of such bonds sliail nol he offered as aforesaid, to exhaust the sinkinc fund to a less amount than ten thousand dollars, then it is hereby made the duty of the Treasurer to advertise in two newspapers, one in New York and one at the Capital «f this State, for three months, wliich advertisements shall state the amount, of the sink ing fund, and the number of bonds numbering them in ihe order of their issuance, which *aoh fund Is se1 apart lo pay and discharge ; and if such bonds, so numbered in • uch advertisements, shall not oe presented for payment aiul cancellation within three months from the expiration nf such publication, then such fund sh ill remain in the Trea- ury to discharge such bonds whenever presented— but tliey shall draw no interest after such publicsition aa last aforesaid.
