" What is the origin ot the word Philopoeoa?"
asks " Kate.': There is some difference of opiu
ion on the subject. The custom which it implies
is said to have beeu introduced into this country
from Germany. The practice is pretty well known
we suppose. A person in eating almonds or auy
other nut iu which may occasionally be fouud two
kernels, invites one of the opposite sex to share
the contents, under the condition that a penalty
shall attach to the one from whom it is first demanded by the other wheu next they meet exclaiming "Philopceua." The penalty is understood to consist of a present. The word t; jihilo,"
is from the Greek p/itlos, a friend, and "poena/'
from the Latin poena, a penally. Some Germans
interpret the word troir vie! liebektn, meaning
"much loved," aud pronounced somewhat like
philipken, and suppose thi? to be its origin, the
termination being changed iatopc&na.
The practice of philopcena is sometimes varied.
Instead of calling out tlie word, the issue is decided by the tirst acceptance of anything from the
hand of another ; and this leads to a variety ot
amusing attempts on one hand to beguile, and on
the other to evade the lure. The issue iu thi!
form keeps the memory and the wit on the alert,
We do not insist upon it that the word philo
poena comes trom the Greek and Latin. Ita origin
may have beeu very different; ai:d somebody had
the discrimination subsequently to bring in the
Greek and Latin by way of giving it a classic renown. Most of us know the admirable classic
play upon the word '■ virgin." In the Latin vir
is " man ;'.' and from the Saxou we have gin, a
" trap ;" so \;e have virgin, a " man-trap." But
no one, we presume, would contend thai the chaste
term virgin eould ever had so equivocal a derivation as that. Lest any crusty old bachelor should
affect so vain a heresy, we tell you, girls, that you
will find in your Italian virgins; in your Spanish
virgen; in your French merge.; iu your Latin
virgo; in all of which we find the Latin the primitive source of lhe word, without the Saxon idea ol
the trap.

Rowe, with intent to defraud and cheat the State,
did, by himself and through his clerk, authorize
the Treasurer of State to receive a large amount
of warrants improperly substituted for coin and
bullion.
Sixth—That said G. W. Whitman, permitted one
of his clerks, W. S. Hqghson, to purchase a large
amount of State warrants, and did Further allow
him to substitute the same for coin paid into the
Treasury by certain couuty treasurers.
Seventh—That said G, W. Whitman, while acting as Controller, accepted an order drawn ou him
as such officer, by J. M. Estill, in contravention of
law.

State Prison.
The committee appointed to confer with the
Lessee of the State Piison and ascertain on what
terms he will consent to surrender his contract
with the State, reported that said Leasee desires
to keep said contract iu preference to auy other
course, but if the State desires it he is willing to
relinquish the same for the sum of one hundred
thousand dollars, out of which a sufficient sum is
to be retained to payoff the present employees
They further state that the Lessee is of the opinion that the labor of the convicts cau be leased
out at $455 per day, or $11,310 per month. To
do this, however, the workshops now in progress
will have to be finished, requiring an outlay of
$6000. They recommended that another story be
added to tbe prison building, and also that a
change be made in the convict law so that two
year convicts can be confined in county jails.

compensation of members of the Legislature a
$450 for the session—was passed by the Senate,
on Friday last. This law, besides saving at 1 ast
$100,000 annually to the over-taxed people of the
State, wiil have the effect to keep mt of our Legislate e men who seek nomination and election
for Ibeprrdiem alone, ancl "carpetbag--' candidates generally. Calilornia has had enough of
such Iaw-raakcrs. To men willing and competent
to occupy a seat in the Legislature the pay is no
olject, provided they get sufficient to defray current expenses.

Union, in its summary of the proceedings of the
Legislature, says: "Another important measure
was theiutroduct.on of a revenue bill by Mr. Jo m-
son, the chief object of which is to enforce the collection of taxes after they are levied. We have
not seen the bill, but are informed tbat it is extremely stringent in its provisions, and will certainly lead to the attainment of a desideratum
never yet reached in our State—it will compel

coons of the finest quality,
Putnam as a Spy.—Among the oflicers of the
Revolutionary army, none probably possessed
more originality than General Putnam, who was
eccentric and fearless, blunt in his manners, tho
daring soldier, without the polish cf the gentleman, lie might well be called the Marion ot tho'
North, though he disliked di.-'gulse, probably from'
the fact of his lisping, which was very apt to overthrow any trickery he might liave in view.
At tins time a stronghold called liorscncck, "
some miles below New York, was in the hands of
the British. Putnam, with a few sturdy patriots,
was lurking in the vicinity, bent on driving them
from the place. Tired of lurking iu ambush the
men began to be impatient, and importuned the
General with a question as to when they were going to have a bout with the foe, One morning he
made a speech something to the following effect,
which convinced them there was something in the
wind :
"Fellows, you have been idle too long, and so
have I. I'm going to Push's, at Horseneck. in an
hour, with an ox team and a bag of corn. Iff
come back I will let you know the particulars ;
if I should not, let them have it, by honkey."
He shortly afterwards mounted his ox cart,
dressed as one of the commonest order of Yankee
farmers, and was soon at Bush's tavern, which wa3
in possession of the British troops. No sooner
did the officers espy him. than they began toques-
tiou him as to his whereabouts, and finding him a
complete simpleion, as they thought, they began
to quiz him and threatened to seize the corn and
(odder.
" How much doyouaskforyouwhole concern?"
asked they.
" For mercy's sake, gentlemen." replied the
mock clodhopper, with the most deplorable look
of entreaty,-'; only let me off, and you shall have
my hull team and load for nothing ; and if that
won't dew, I'll give you my word I'll return tomorrow and pay you heartily for your kindness
and condescension."
"Well," said they, "we'll take you at your
word. Leave the team and provender with us,
and we won't require bail for your appearance."
Putnam gave up the team, and sauntered about
for an hour or so, gaining al! the information he
wished. He then returned to his men and told
them of the foe, and his plan of attack.
The morning came, and with it sallied out the
gallant band. The British were handled with
rough hands ; and when they surrendered to Gen.-
Putnam, the clodhopper, he sarcastically remarked:
" Gentlemen, I bave kept my word. I told you
I would call and pay you for your kindness and
condescension."
Election in Sacramento.—The Democratic
Charter Convention has nominated the following
ticket, to be supported at the election to be held
on Monday, April llth : Mayor, J. P. Dyer; Recorder, Presley Dunlap j Treasurer, James Sullivan ; Collector, John H.IIousniau ; Marshal, James
Lansing; Attorney, George R. Moore; Assessor,
Alex. Montgomery ; Superintendent of Public
Schools, J, G. Lawton, Jr.
A young man named Jeffords was severely injured at Jackson, Amador county, by the ptema-
ture discharge of a blast, while engaged in blasting wood for ttie Jackseo Gas Company. Another
man, who happened to be passing at the time, was
struck in the lace and on the head with pieces ol
wood, injuring his skull seriously. They were
both well cared for by the company.
A lady relating her matrimonial experience
said :
At first, on retiring of a cold night, my husband

with mine ; but soon it was " keep your hoofs off

The citizens of Rancheria diggings agar Oroville, have resolved to give their town the namo
of Columbia. There are ouly '18 Columbias already iu the Uuited States; with this oue added
there is still one lacking to make up the half hundred.
Nathan L. Sanders was accidentally shot by a-
pistol in his own possession at Fiddletown, Amador county. Jiimes McCain was killed by the caving of a bank at Rough and Ready, in Nevada
county.
A bill bas passed the Legislature abolishing the
Superior Court of San Fraucisco. The books and
papers are to be transferred to the Fourth District
Court.
A man, name unknown, fell down a precipice
sixty feet high in Sau Francisco. He was alive
at last accounts. None of his bones were fractured-
On the 21st March, the firemen ol San Francisco, welcomed Hon. Mr. Coffroth on his visit fo
that city, by a procession, firing ol gnus. Ae-. for
his exertions in the passage of the new bill regulating the department.
Sacramento papers chronicle the fall of a brick
building, by whieh Mrs. Sarah Ann MeCabe lost
her life and several other persons narrowly escaped. The destWQtiW of property was considerable.

The custom which it implies is said to have beeu introduced into this country from Germany. The practice is pretty well known we suppose. A person in eating almonds or auy other nut iu which may occasionally be fouud two kernels, invites one of the opposite sex to share the contents, under the condition that a penalty shall attach to the one from whom it is first demanded by the other wheu next they meet exclaiming "Philopceua." The penalty is understood to consist of a present. The word t; jihilo" is from the Greek p/itlos, a friend, and "poena/' from the Latin poena, a penally. Some Germans interpret the word troir vie! liebektn, meaning "much loved" aud pronounced somewhat like philipken, and suppose thi? to be its origin, the termination being changed iatopc&na. The practice of philopcena is sometimes varied. Instead of calling out tlie word, the issue is decided by the tirst acceptance of anything from the hand of another ; and this leads to a variety ot amusing attempts on one hand to beguile, and on the other to evade the lure. The issue iu thi! form keeps the memory and the wit on the alert, We do not insist upon it that the word philo poena comes trom the Greek and Latin. Ita origin may have beeu very different; ai:d somebody had the discrimination subsequently to bring in the Greek and Latin by way of giving it a classic renown. Most of us know the admirable classic play upon the word '■ virgin." In the Latin vir is " man ;'.' and from the Saxou we have gin, a " trap ;" so \;e have virgin, a " man-trap." But no one, we presume, would contend thai the chaste term virgin eould ever had so equivocal a derivation as that. Lest any crusty old bachelor should affect so vain a heresy, we tell you, girls, that you will find in your Italian virgins; in your Spanish virgen; in your French merge.; iu your Latin virgo; in all of which we find the Latin the primitive source of lhe word, without the Saxon idea ol the trap. The committee appointed to confer with the Lessee of the State Piison and ascertain on what terms he will consent to surrender his contract with the State, reported that said Leasee desires to keep said contract iu preference to auy other course, but if the State desires it he is willing to relinquish the same for the sum of one hundred thousand dollars, out of which a sufficient sum is to be retained to payoff the present employees They further state that the Lessee is of the opinion that the labor of the convicts cau be leased out at $455 per day, or $11,310 per month. To do this, however, the workshops now in progress will have to be finished, requiring an outlay of $6000.
