change the Constitution of thia State

attachments ngainst their property.
Also, an act to protect Irom forced sale a certain portion of the homestead, and other property,
of all heads of families.
Mr. Shaw submitted the following, which was
adopted :
Resolved, That the Controller be and is hereby
requested to furnish, for the use of tlie Sedate,
full and p-irticutar account (irrespective of any
hiiormation which may be contained in his reports) of all the warrants drawn by the Controller
upon the Treasurer of State, from the Brat organization of th- 0__*troH-r'- o~aa down to tli. pre_>
ent time, specifying the objects for which ihey
-.ere drawn and th(> particulars as far as oau be
necessary for a compiete understanding of the
purposes to which the moneys therein directed io
be paid were respectively appropriated, classify-
the same under the Legislative, Executive and
Judicial departments, and showing separately
every item or class of items of expense iu any
manner incurred or contracted under or in support
of each of the said departments, and for which
Controller's warrants have been drawn during tha
aforesaid period, specifying the dates and footing
up the amounts given. Also, the exact amount
of all Controller's warrants issued, and of all debts
and liabilities in any way contracted or incurred
by the Government from the 15th December, 1849,
to the 5th of January, 1867.
On motion of Mr. Tilford, the Senate adjourned.

The Senate of California was called to order at
precisely 12 o'clock noon, by the Lieutenant Governor, Robert M. Anderson, President of the Senate.
The Rev. J. A. Benton,of Sacramento, then opeusd
the proceedings with prayer.
The President of the Senate, on taking the chair,
remarked:
Senators : The period for your annual deliberations upon the interests and the welfare of the
State has arrived, and I deeply regret that I cannot congratulate you upon a better condition of
affairs. The deranged state of our financial affairs,
the passage of necessary laws, and amendments to
existing ones, are subjects fraught with lively and
intense interest, not only to your immediate constituents, but to the honor of the whole State, affecting as they do the whole financial world.
Trusting that you may prove equal to the task,
and that your acts may be written in letters of
living light upon the statutes of the country, and
etaud as monuments in all time to come—engaging that I will extend to each of you, I trust to
receive the usual courtesies of life. I bid you
God speed in your work.
Wm. Bausinan, Secretary ot the old Senate, then
called the roll of new .Senators, who, ae their ^ receive
Mr. Beatty, of Calaveras; W. W. Sheppard, of
San Francisco; and A. M. Stephenson, of Solano,
were nominated.
Mr. Beatty having received a majority of all tht
votes cast, was declared elected Speaker of the
Assembly.
After taking the oath of office, the speaker arose
and said:
Gentlemen of the Assembly—I trust you will
not deem it the affectation of a sentiment which I
do not entertain, if I assure you that seldom before
in my life have I approached the performance of
any duty under feelings of deeper mistrust, than
that which devolves upon me as the presiding
officer of this body. And if, in the discharge of
the duties of the distinguished position which
your partiality has conferred upon me, I shall at
any time fall short of your expectations, I have
only to ask at your hands tha> lenity and indulgence which is always awarded to those who discharge their duties to the best of their abilities.
In my seat ia this body, for the last two years:
I have endeavored to devote my best energies
faithfully to the best interests of a generous and
confiding constituency, and I tsust that experience
lias sufficiently demonstrated to my mind the re"
sponsibility of the representative character, and
this last crowning act of your favor I fear far exceeds my merits, and the only way I cau thank
you, is to promise you that I shall diligently devote myself to the duties of the part you have
assigned me, with the view of proving myself in
some degree worthy of it. It may not be amiss,
gentlemen, at the con_.nenc<'ineiit of a new session
briefly to allude to the character of the work
whieh will claim our serious and honest consider
ation. Perhaps the most important action of this
Legislature will be the election of two gentlemen
to represent our people in the .Senate ot the United States. Tho varied and responsible duties,
and the immense public interests which it compasses, it is to be hoped will clearly exhibit the
necessity of maturejudgment aud souud discretion
in the selection of those who are to re'present our
iState iu the councils ofthe nation for the next
four aud six yea.s. The indebtedness ofthe State
largely exceeds the amount prescribed iu the organic law as the limit beyond which the Legisla
ture shall not go, without the express consent of
the people at the ballot-box. For mauy reasons,
however, it seems true that the amount there fixed
has not been sufficient to meet the current expeu,
ses of the government; and former Legislatures
have created a debt which,in the aggregate
amounts to more than six times that prescribed
in the Constitution of the State ; and a recent decision ofthe Supreme Court declares the entire
excess over $300,000 unconstitutional and void.
It therefore seems proper that this subject should
your early 'consideration ; that you should
devise some means of settling this vexed que-uion„
and submitting them, in some .haf**.. for the approval ofthe people. In short, gentlemen, it devolves upon you, as the represcnUtir-» of the people, to d-.ettQ4oe, in a great irw.asi-ie. how far the-

A bill to authorise the sale of swamp and overflowed lands iu the State of California.

A b;ll to increase the revenue of the State.
A bill to consolidate the city and county uf Sacramento.
An act in amendment of an act for the disposition of swamp and overflowed lauds in the -State.
Joint Convention.
Both houses met iu Joint Convention at 1 o'clock
P.M. on Saturday, the 10th Inst. The chair wa*
taken by tho President of the Senate, Lieutenant-
Governor Anderson, and the Speaker of the Assembly, Hon. Mr. Beatty. Mr. McGee was appointed Teller for the Senate j Mr. O'Neill for
the Assembly.
Mr. Westmoreland offered a resolution to go into*
the election of Uuited States Senator, to fdl th*
vacancy which will occur on the 4th of March,,
1857, in the place of the Hon. J. B. Weller.
Mr. Hall moved tu amend by electing a Senator
for the short term first, to fill the vacancy of the
Hou. \V. M. Gwiu.
The President decided that, in conformity with
the joint resolution, tbe convention were compelled to go iuto au election to Oli the short term first,
Mr. Westmoreland appealed from the decision
of the chair, and Mr. Tilford seconded the appeal.
There waa then a debate held on the matter, in
which Messrs. Tilford, Mandeville. Ashley and
others joined.
Tiie Convention refused to sustain the decision
ot the President to go into au election of a Senator for the short term first by a vote of yeas _7,
nays 84.
The President announced the official vote ofthe
first ballot. It is as follows :
