First, the bill.
AA" ACT to require the Controller to audit
eertain bills ofthe members and officers of the
present Lcsiglatnre.
The people'of the State of California, represented in the Senate and Assembly,do enact as follows :
Section 1. The Controller of State is hereby
required to audit, and the Treasurer to pay out of
the general fund which may now boon liand, or
which may hereafter b- recived, the per diem or
mileage allowance of thc present Legislature, to
the amount of one thousand dollars each. Also to
audit and pay the per diem of ofiieern of said Legislature for sixty days, so soon as their services are
rendered, and accounts are certified to by the
proper officers of their respective bodies. Provided : If there should not beso much in the treasury at any one time, then c;'ch member shall receive a pro rata proportion, from time to time,
until he has received the full sum to which he is
entitled under this Act.
On the 30th of January, the Governor transmitted the following message, returning the Act, and
assigning hia reasons for witholding his approval:

To the Assembly of California :
An Act entitled " An Act requiring the Control-
lev to audit certain bills ofthe members and ofiii-'i'.-
of the present .Legislature,'' is herewith returned
to iiie Iiouse in which ¡t originated, without approval.
The Act requires the "Controller to nduit, and
the Treasurer to pay out of the general fund which
may be on hand, or which may be hereafter received, the per diem aud mileage of the members of
the present Legislature, to the amount of one
thousand dollars each, mid-to-pay, the per diem of
the officers of said Legislature for Sixty days, so
soon as their services are rendered and accounts
are certified- to by the officers of their respective
bodies."
Aware th.it the failure of the State to "pay on
demand aud iu cash for services performed, subjects the rcpreseutatives of the people and all
others in her employ to serious inconvenience and
loss, if I believed that the Act under consideration
remedied the evil, or would materially better their
condition, 1 would willingly give it my approval.
In fact, if the amount of cash therein appropriated
and set apart were now in Jhe general fund, it
would give me sincere pleasure to assent to the Act
becoming a law. -_^^^^^^^^^^^^^™
But, in view of the fact that the State Treasurer
reports that there is, at this date, no cash Id the
general fund, and also that the Controller ami
Treasurer concur in opinion, that, for the reasnn
that nearly, if not quite all the revenue accruing
under tbe last assessment, has been airen'y received and disbursed, a sufficient ¡iniouut of cash to
meet the requirements of the Act will not have accumulated id that fund within seven months, I am
satisfied that its approval, so far from benefiting
the members and officers of the Legislature.wouhl,
in the end, prove injurious to them and to all others
directly interested. Injurious, because calculated
greatly to weaken public confidence in the ability
of the State to promptly meet accruing liabilities,
and, of course,cause material depreciation iu every
description of State indebtedness.
At this date, the total amount of Controller's
warrants outstanding, exceedd two hundred thousand dollars.
Most of these warrants were issued for mnterials
and services long since furnished and performed,
and the holders of them are doubtless desirous,
and expecting to receive in cash from the general
fund, the amount called for on the face of each,
which is clearly their right, as soon as a sum «Mr
cient for their redemption shall have accumulated.
But the Act in question, if approved, would compel
the proper officer to postpone the payment of these
warrants until-each member ofthe present Legislature sliall have received the sum of oue thousand
dollars, aud each ollieer his per diem tbr sixty days,
amounting, in the aggregate, to about one hundred and fifty thousand dollars.
The knowledge of the legislative enactment, if is
believed, would not outy greatly depreciate Civil
Warrants now outstanding, and inflict unnecessary
hardship on existing creditors of the State, but
would .also-, in the same degree, depreciate those
hereafter to. be issued, thus largely increasing
State expenditures, for the rea.sou that Yah amount
of such depreciation would, in almost ovury instance, beadded to the cash value of articles furnished or labor performed.
It has been urged in favor of the pawnee of this
act, that tljevc exists a combination ot bankeis and
brokers, far the purpose *>f depreciating the Civil
Warrants oir the State- If it be true, which is by
no means certain, that there exists such ;i combination, the act tinder consideration, so far from ¿is*
banding this combination and defeating ita objects
by rendering less profitable the purchase of State
Civil "Warrants,will actually effect the depreciation,
which, it is alleged, the combination is laborlnu
to produce, and, instead ofreducing, will great:;-*
increase thc profits arising from the purchase and
iibsequent redemption of evidences of State iu-

with the representatives of the people, but entertaining the opinion, from which, I. foe] confident.
