Re: Freedom of Information Act Request
Greetings,
Under the provisions of the Freedom of Information Act, 5 U.S.C. 552, I am
requesting access to all records relating to the deportation proceedings
against Diamond Kimm, a one-time Korean resident of Los Angeles, student at the
University of Southern California, and publisher of a bilingual newspaper
during the 1940s-early 1950s. His case went before the Supreme Court in May
1960, and he lost the decision (Kimm v. Rosenberg, 363 US 405).
If there are any fees for searching for, or copying, the records I have
requested, please send an invoice for that amount before you fill the request.
As librarian of the Korean Heritage Library, of the University of
Southern California, I am requesting this information as part of an ongoing
program of gathering archival and other research materials relating to the
Korean community of the Los Angeles region. Our plans are to bring together
all the sources necessary for scholars to eventually piece together the full
story of Koreans in the United States. As you know, the act permits you to
reduce or waive fees when the release of the information is considered as
"primarily benefiting the public11. I believe that this request fits that
category and I therefore ask that you waive any fees.
If all or any part of this request is denied, please cite the specific
exemption(s) which you think justifies your refusal to release the information,
and inform me of the appeal procedures available to me under the law.
I would appreciate your handling this request as quickly as possible, and
I look forward to hearing from you within 10 days, as the law stipulates.
