Former university tailback Aaron Emanuel was sentenced to a short jail term and three years probation Monday in Pasadena.
Judge Judson Morris Jr. sentenced Emanuel to three years probation, a 14-day jail term to be served on seven consecutive weekends, 104 hours of community service work—52 hours of which must be spent at a battered women's facility or hospital and continued counseling with emphasis on self-control.
“I take it as it comes,” Emanuel said after the sentencing.
The former tailback was found guilty of misdemeanor battery on Aug. 21, for punching Sharon Hatfield, a former university Hep-tathlete, at a private party last spring.
Emanuel could have received six months in jail, a S2.000 fine or both.
Lawrence Elkins. Emanuel's attorney, “speaking from the heart" told reporters after the sentencing that he does not feel the jail time is appropriate.
Elkins called the sentence “severe" and accused Morris of being "extremely heavy handed.”
Morris orignally sentenced Emanuel to 15 days in jail but later reduced the sentence by one day.
Emanuel, who said he did not expect a jail term, must begin the sentence on or before Nov. 6.
Elkins, who scheduled Emanuel to begin on the deadline date, said the overcrowded jails were not appropriate for Emanuel's rehabilitation.
“I have no intention of Aaron
Emanuel serving time at the county jail.” Elkins said. “(It serves) no purpose for rehabilitation or retribution."
Elkins said he will work to find a location outside of Los Angeles County where Emanuel can serv e his time. He said Emanuel would not serve his jail sentence in the downtown facility.
“The man has suffered enough." Elkins said.
He said the sentence was not outlandish for the crime, but it was inapplicable to his client's situation.
“I'm very disappointed (the judge) gave any jail time.” Elkins said.
If Emanuel fails to appear for his jail time on any of the seven weekends of his sentence he will have to serve straight time to complete it
The university suspended Emanuel for the 1987-88 academic year. However.both Emanuel and Elkins mentioned a different date for the former tailback's return to the university.
Elkins said the university would allow Emanuel to enroll for the spring semester.
Emanuel said he is “leaning toward going back in January” He said he has not made any commitments.
